Consider the following scenario:
Grace is desperately in love with Delphin, her friend Alida’s fiance. May Grace attempt to woo Delphin to herself and away from Alida?
I see at least three potential Halachic problems here:
- עני המפך בחררה ובא אחר ונטלה הימנו נקרא רשע
- Halacha considers breaking an engagement tortious1, possibly even actionably so2 due to the presumed consequent humiliation of the jilted party. An inducement to break an engagement might therefore be considered גרם היזק.
- דברים יש בהם משום מחוסרי אמנה. One who breaks an engagement without a valid reason might therefore be considered a Rasha, and one who incites such an action might therefore violate the prohibitions of לפני עור לא תתן מכשול ומסייע לידי עוברי עבירה
My next post on this topic will, בג”ה, be a survey of the Halachic literature dealing with the first of the above concerns, namely, the applicability of the principle of עני המהפך בחררה to Shidduchim.
